Scope of the Terms and Conditions of Use

Use of the platform, (hereinafter "Platform"), is proposed by: Allianz Asia Lab, Allianz SE Singapore Branch, #14-01, 12 Marina View, Asia Square Tower 2, Singapore 018961, +6562978802 (hereinafter "Platform Operator").

Use of the Platform are subject to these Terms and Conditions of Use.

"Partners" are partner users registered on the platform. "Allianz Employees" are Allianz employees who are registered on the platform. Both Partners and Allianz Employees are users (hereinafter “Users”) of the platform.

Logging on to use the Platform as a Partner may take place once a membership account has been created by means of registration. Potential Partners registrations are vetted by the Platform administrators before registrations are deemed successful. Advertised Products and Services (hereinafter, “Products) are volunteered solely by the Partners and belong entirely to the Partners.

  1. Use of the Platform

    Logging on to use the Platform as an Allianz Employee may take place once a membership account has been created by means of registration. The precondition for the registration as an Allianz Employee is that the potential Allianz Employee is an existing Allianz Employee with a valid Allianz domain email address.

    Use of the Platform is free of charge.

    Only natural persons with authorization from their companies are permitted to register on behalf of their company as a Partner. When registering, Partners and Allianz Employees shall provide the assurance that they fulfill the requirements of, and shall continue to comply with, the provisions in these Terms and Conditions of Use.

    Multiple registrations by Partners and Allianz Employees, and access via third parties are not permitted.

    No right to register shall exist for the purpose of using the Platform. The Platform Operator is entitled, at its own discretion and without providing any reason, to bar individuals from registering and deny them use of the Platform.
  2. Offer of the Platform Operator

    The Platform Operator offers Partners of the Platform the possibility to advertise their Products on the Platform. The Platform Operator offers Allianz Employees the possibility to access information about the Products. Additionally, Allianz Employees have the possibility of requesting for collaboration with the Partner through the Platform Operator.

    Partners within the framework of Partners can be individuals, external companies and organizations.

    The respective Partner and the subject of the specific Product, including Product descriptions, are shown in detail on the Product page.
  3. Contributions in the context of Products and Comments

    Users undertake not to publish any illegal contributions and/or contributions that offend public decency. Such contributions may be deleted from the page immediately and without prior consultation and constitute extraordinary grounds for termination.
  4. Obligation to Secrecy

    Users must not pass on to third parties, username and password or to give use of the Platform to third parties.

    User undertakes to treat as confidential, for an indefinite period of time, all information received by platform provider which are not publicly known.
  5. User’s Obligations

    The Partner shall confirm during the input of contributions that they have created by themselves and are submitting these in their own name and that no third-party rights exist, including but not limited to copyright, trademark and design rights or patents, business designations, company property, rights to one's own image or trademark rights. This also includes in particular the obligation not to submit any contributions that infringe company and/or trade secrets or the like (including but not limited to know-how) of their employer or of a third-party in respect of whom they are obliged to secrecy;

    The Partner agrees that the Platform Operator may publish the contributions of the Partner so that they are visible to all Allianz Employees on the Platform.

    The Platform Operator may at its discretion and at any time delete Partner’s contributions. In principle, the deletion of a contribution takes place only if the Partner does not adhere to the Terms and Conditions of Use or comply with the requirements of the Product descriptions or if, in the view of the Platform Operator, the contribution does not fulfill the submission criteria specified in the product description.

    Should the issue of copyright, intellectual property, trademark, privacy or other proprietary rights arise as a result of the Partner’s contributions, then Partners shall grant the Platform Operator - at the time of their coming into existence and free of charge – the exclusive rights unrestricted in time, space and content to the contributions submitted, for their unrestricted use and exploitation.

    By submitting a Product, the Partner declares that he/she has so far made no dispositions which would oppose granting a right to use the contribution to the extent described in 11. In this respect, the Participant shall indemnify the Platform Operator from all third party claims.
  6. Premature Termination of the Product / Terminating Membership

    The Platform Operator reserves the right to interrupt or end the access to the Platform at any time without prior notice and without providing any reason. Claims made by Partners or Allianz Employees as a result, in particular claims for damages, shall not be accepted.

    The Platform Operator may terminate the membership of a User by a simple e-mail and delete their member's account. Users may terminate their membership at any time with future effect by requesting to deleting their member's account by use of a simple e-mail to the Platform’s Operator.

    If a User who terminates its membership by deleting its member's account or who has received notice of termination, has already submitted a contribution, the latter may be deleted when the membership ends.
  7. Liability of the Platform Operator

    The Platform Operator is liable for damages - irrespective of any legal grounds – only:
    • as a result of willful intent;
    • as a result of gross negligence by the Platform Operator, its legal representatives or its vicarious agents;
    • in the event of culpable injury to lives, limb or health;
    • in respect of defects which it has intentionally concealed or the absence of which it has guaranteed;

    All further claims shall herewith be excluded.
  8. Liability of the User

    The User shall indemnify the Platform Operator from all demands and claims by third parties based on a breach of these Terms and Conditions of Use by the User.

    The User shall ensure that data, designs, sketches and information sent to the Platform Operator are free from viruses and other harmful programs. To this end, the User shall implement state-of-the-art anti-virus software. Damage caused to the Platform Operator by viruses transmitted or other harmful software shall be reimbursed to the Operator by the User.
  9. Liability of the Partner

    The Partner is liable for the content posted by him according to legal regulations. His further liability towards the users can be changed notwithstanding the Product descriptions. On this platform operator has no influence.
  10. Copyright/Rights of Use

    The Platform Operator or its service providers, as applicable, own the copyright or the rights of use of all pictures, videos, films and texts published on the Platform, except where this concerns sections of Users contributions, comments etc. Using the pictures, videos, films and texts is not permitted without express written agreement from the Platform Operator or its service providers, as applicable.
  11. Data Protection

    The Partner and Allianz Employee ‎agree that the Platform Operator collects and uses certain person-related data (name, e-mail address) provided by the Partner or Allianz Employee in accordance with the regulations of data protection law.

    All personal data is handled strictly confidentially. Person-related data necessary for execution and completion of the Project is stored and used by the Platform Operator and made available, where required, to service partners assisting the Platform Operator in executing the contract (including but not limited to postal services).

    Subject to the consent of the Allianz Employee, the following information is sent to the Allianz Employee:
    • Newsletters containing news posted on the Platform;
    • Updates to favorited Products;
    • Comments by other Users on Products;
    • Notified about the newest Products;

    The Partner may modify the information to be received under "MY ACCOUNT", “SETTINGS” Tab.

    Subject to the consent of the Partner, the following information is sent to the Partner:
    • Newsletters containing news posted on the Platform;
    • Summary statistics about engagements with Partner’s Product

    The Partner may modify the information to be received under "MY ACCOUNT", “SETTINGS” Tab.

    The responsible authority under the terms of the data protection acts is the Platform Operator. Users shall accept the general data protection statement to access the Platform Operator. If the Users, he/she should immediately leave the Platform.
  12. Other Provisions

    There shall be no legal recourse as regards collaboration between Partners and Allianz Employee by introduction of the Platform Operator.

    These Terms and Conditions of Use and any disputes arising from or in connection with these Terms and Conditions of Use are subject to the law of the Republic of Singapore. For all disputes involving Users the particular jurisdiction for disputes arising from the collaboration is Singapore. The Platform Operator reserves the right meanwhile to sue the User at the court where they reside. The place of fulfillment for all the rights and obligations resulting from the contract shall be solely Singapore.

    The Platform Operator may modify these Terms and Conditions of Use without providing a reason. Between the User and the Platform Operator, it is the most current version of the Terms and Conditions of Use and Participation to which the User has agreed to.

    The Participants shall therefore from time to time visit the Operator Platform and verify the date of the Terms & Conditions version.

    If individual regulations in these Terms and Conditions of Use prove to be totally or partly legally ineffective and/or incomplete, then the validity of the remaining conditions shall not be affected. Invalid provisions shall be replaced, through agreement, by those suitable for achieving the desired economic outcome with consideration to the interests of the contracting parties. If translations of the present Terms and Conditions of Use and Participation be made available, the English language version shall be the sole valid version.
